1. Acceptance of Terms
These Terms of Service ("Terms") form a legal agreement between you ("you," "agent," or "subscriber") and Overton Insurance Solutions, LLC, doing business as MyBundlePro ("we," "us," or "MyBundlePro"), an Arkansas limited liability company headquartered at 813 Oak St, Ste 1, Conway, AR 72032.
By creating an account, accessing, or using MyBundlePro, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility
To use MyBundlePro, you must:
- Be at least 18 years old
- Be a U.S.-based licensed insurance agent in good standing, or a licensed insurance agency, or an authorized representative thereof
- Hold all required state insurance licenses, appointments, and certifications for the products you sell
- Comply with all applicable insurance laws and regulations
- Provide accurate and complete account information
We reserve the right to refuse service or terminate accounts at our discretion for ineligibility or violation of these Terms.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@mybundlepro.com if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account that result from your failure to safeguard credentials.
4. Subscription, Billing, and Refunds
4.1 Subscription plans
MyBundlePro is offered on a subscription basis. Plan details, pricing, and features are described on our pricing page and may be updated from time to time. Your subscription continues until you cancel.
4.2 Free trial
We offer a 14-day free trial that does not require a credit card. At the end of the trial, you may choose to subscribe. We will not charge you unless you affirmatively start a paid subscription.
4.3 Billing
Paid subscriptions are billed monthly or annually in advance, depending on the plan you select. By providing payment information, you authorize us (and our payment processor) to charge your payment method for the subscription fees and any applicable taxes.
4.4 30-day money-back guarantee
If you are not satisfied with MyBundlePro within the first 30 days of your first paid subscription, contact us at hello@mybundlepro.com and we will refund your most recent payment in full. The guarantee applies only to your first 30 days on a paid plan.
4.5 Cancellation
You can cancel anytime from your account settings or by emailing us. After cancellation, your subscription remains active until the end of the current billing period; you will not be charged again. We do not provide prorated refunds for partial months or partial years (except under the 30-day money-back guarantee).
4.6 Price changes
We may change subscription prices. If we change the price of your active plan, we will give you at least 30 days' notice before the new price takes effect, and you may cancel before the change applies.
5. Acceptable Use
You agree not to:
- Use MyBundlePro for any unlawful purpose or in violation of any applicable law, including insurance laws and regulations
- Misrepresent yourself, your licensing, or your relationship to clients
- Enter false or misleading information into the platform, or use MyBundlePro to deceive clients
- Attempt to access another user's account or any system or data you are not authorized to access
- Reverse engineer, copy, modify, or create derivative works of the platform
- Resell, sublicense, or commercially exploit MyBundlePro or its outputs outside of your insurance practice
- Send spam, unsolicited communications, or marketing in violation of TCPA, CAN-SPAM, or similar laws
- Upload viruses, malware, or any code intended to harm the platform or its users
- Interfere with or disrupt the operation of MyBundlePro or its infrastructure
We may suspend or terminate accounts that violate these rules, with or without notice.
6. Compliance Responsibility
This is important. MyBundlePro provides workflow tools to help you do your job — including tools designed around CMS Scope of Appointment (SOA) rules, cross-sell organization, and client-facing visualizations. However:
You are solely responsible for your own compliance with all applicable laws, regulations, carrier requirements, and ethical standards governing insurance sales, including but not limited to:
- State insurance licensing and continuing education requirements
- Centers for Medicare & Medicaid Services (CMS) rules, including SOA requirements, marketing guidelines, and the CMS Final Rule
- Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act for communications with prospects and clients
- HIPAA, where applicable to client health information
- Carrier-specific compliance requirements and producer agreements
- State-specific consumer protection laws and disclosure requirements
MyBundlePro is a tool. Using MyBundlePro does not make you compliant; it helps you organize your workflow. You remain the licensed professional accountable for every appointment, sale, and communication. We make no representation that any feature of MyBundlePro guarantees compliance with any specific law or rule. When in doubt about a compliance question, consult your carrier, your FMO/IMO, your state insurance department, or a qualified attorney.
7. Intellectual Property
7.1 Our IP
MyBundlePro, including its software, design, content, features, and trademarks, is owned by Overton Insurance Solutions, LLC and protected by U.S. and international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use MyBundlePro during your active subscription, solely for your insurance practice.
7.2 Your data
You retain ownership of all data you enter into MyBundlePro, including client information, configurations, and notes. You grant us a limited license to host, store, process, and display your data solely as necessary to provide the service to you. We do not use your data for any other purpose. You can export your data at any time during your subscription, and for a reasonable period after cancellation upon request.
8. Third-Party Services and Integrations
MyBundlePro may integrate with third-party services (such as your CRM, calendar, payment processors, or carrier systems). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of third-party services. If a third-party service is unavailable, MyBundlePro features that depend on it may not function until the third-party service is restored.
9. Disclaimers
MyBundlePro is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted service. We do not warrant that the platform will be error-free, secure, or available at all times.
MyBundlePro does not provide legal, financial, tax, insurance, or compliance advice. Information available through the platform — including educational content, templates, or workflow guidance — is for informational purposes only and is not a substitute for professional advice or independent professional judgment.
10. Limitation of Liability
To the maximum extent permitted by law, in no event shall MyBundlePro, Overton Insurance Solutions, LLC, or our officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of (or inability to use) MyBundlePro, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising from or related to MyBundlePro or these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred dollars ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless MyBundlePro, Overton Insurance Solutions, LLC, and our affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of MyBundlePro, (b) your violation of these Terms, (c) your violation of any law, regulation, or third-party right (including any compliance failure in your insurance practice), or (d) any client data you enter into MyBundlePro.
12. Termination
You may terminate your account at any time by canceling your subscription and contacting us to request data deletion. We may suspend or terminate your account at our discretion, with or without notice, if you violate these Terms, fail to pay, or for any other reason permitted by law. Upon termination, your right to use MyBundlePro ends immediately. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of MyBundlePro shall be resolved exclusively in the state or federal courts located in Faulkner County, Arkansas, and you consent to the jurisdiction of those courts.
You and MyBundlePro both waive any right to a jury trial. Neither party may bring claims as a class action or in a representative capacity.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the service before the changes take effect. Your continued use of MyBundlePro after the effective date constitutes your acceptance of the updated Terms. If you do not agree, your remedy is to stop using the service and cancel your subscription.
15. Miscellaneous
- Entire agreement: these Terms and our Privacy Policy constitute the entire agreement between you and MyBundlePro regarding the service
- Severability: if any provision is held unenforceable, the remaining provisions remain in effect
- No waiver: our failure to enforce any provision is not a waiver of our right to enforce it later
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale
- Force majeure: neither party is liable for delays or failures caused by events beyond reasonable control
